General Terms and Conditions of Purchase and Use
Preamble
Please read these general terms and conditions of sale (hereinafter the “Terms”) before making a purchase on our website. These Terms apply to the use of our website and to orders sent to medin-art. You are expected to read and accept these Terms before being permitted to use the website. Any use of an account on this website by a person under the age of 18 is forbidden and prohibited by these Terms. Medin-art reserves the right to limit, amend, suspend or replace the website and these Terms at any time. Although we endeavour to keep you informed when these Terms are updated, we recommend that you review them regularly in order to stay aware of any amendment, limitation, change or replacement. By continuing to use the website, you accept such amendments, limitations, changes, suspensions or replacements.
1. Scope
The operator of the online shop, accessible at www.medin-art.com (hereinafter the “online shop”), and your contracting partner, is the company medin-art. These Terms apply to all contracts concluded between you as the customer and us as the operator of the online shop (hereinafter the “seller”). When placing an order, you accept the Terms in the version in force at the time your order is placed. In order to be binding, any oral or telephone agreement must be confirmed in writing. This written-form requirement is also deemed to be met when a statement is made by email.
2. Formation of the contract
The offer to conclude a contract of sale comes from the customer when, having completed the order page in full, the customer clicks the “Buy” button. The customer remains bound by the order for a period of one week. The contract becomes binding if we accept the order within that period, in accordance with the following paragraphs. After sending the order, the customer receives an automated email in which we confirm receipt of the order (order receipt confirmation). The sole purpose of this order receipt confirmation is to inform the customer that we have received the order. A valid contract is not actually formed until we declare our acceptance. We declare acceptance of the contract when we send the customer an invoice, when we confirm the order (confirmation of acceptance of the order), when we confirm by email that the goods have left our warehouse (dispatch confirmation) or, at the latest, upon delivery of the goods. A contract can only be formed for the items expressly listed in our invoice, in the confirmation of acceptance of the order or in the dispatch confirmation. Ultimately, this defines the full scope of the services provided.
3. Prices and shipping costs
All prices are net of VAT and quoted in Swiss francs (CHF). We reserve the right to amend the prices, terms and rates shown on our website, the reference date being the day of the order. Shipping costs are included in the sale prices.
4. Payment and retention of title
Payment of the sale price may be made by credit card, PayPal, bank transfer or TWINT, according to what is provided for and available on the website. When paying by credit or debit card, the data transmitted is encrypted. Except where payment is made by invoice, orders are payable immediately. As a customer, you are entitled to set-off or to a right of retention only to the extent that your claim has been established by a court decision that is final or undisputed. This provision does not affect your rights in the event of defects in the goods delivered.
5. Returns and refunds
Returns policy: the customer has 10 working days from the date of receipt to return the product. The customer must contact medin-art customer service to notify the intended return or exchange within 10 working days of receiving the product. The product must be returned in the same condition in which it was received. If a customer returns the product, the return shipping costs are borne by the customer. We will refund the customer the full amount paid for the product, less the original shipping costs incurred by medin-art (which offers free shipping within Switzerland). The customer will be refunded only via the original payment method, and to the same card as the one used for the purchase in the case of a card payment. If the customer requests an exchange or a voucher, the full amount will be refunded.
6. Delivery and transfer of risk
The seller limits deliveries to within Swiss territory. Deliveries are made directly to the delivery address and to the contact person provided by the buyer. Delivery takes place on condition that we ourselves have been supplied correctly and in good time by our own suppliers. In the event of force majeure, such as strikes or other industrial action, riots, war or natural disasters, or if delivery is not possible, we reserve the right to cancel the order.
